These terms govern the use of this website and the booking of the short-term rentals managed by PNstays (ALEP member no. 4676) in Funchal, Madeira. By booking, the guest confirms they have read and accepted these conditions.
This website presents the apartments, their availability and a price estimate. When you pick dates and submit the form, you are making a booking request — not a confirmed booking.
We check availability and reply with the confirmation and payment instructions. The accommodation contract is only formed once we expressly confirm and payment is made on the stated terms. Until then, the dates are not reserved.
The figures shown in this site's calendar are an estimate. The final, binding total is the one we state when we confirm your request.
Payment is made after our confirmation, by one of two routes, stated in our reply:
If the second payment is not made by the stated deadline, we will let you know before taking any decision. If it remains unpaid, the booking is cancelled and the cancellation conditions in force on that date apply (section 5).
Security notice: our bank details never change and we will never ask you to transfer to a different IBAN. If you receive a message giving another account, even if it appears to come from us, do not transfer and contact us on the phone number shown on this website.
A security deposit may be requested, under section 8.
Counted from the check-in date and from the moment we receive your cancellation in writing:
The municipal tourist tax is always refunded if you cancel, because it is only due if the stay takes place.
Leaving early does not entitle you to a refund of the nights not used.
Refunds are issued through the same payment method, within 14 days of the date we accept the cancellation.
Requested more than 14 days in advance and subject to availability, we change your dates at no charge — the stay is then priced at the rate in force for the new dates, which may be higher or lower. Requested less than 14 days in advance, or where there is no availability, the request is treated as a cancellation under the terms above.
If, for reasons attributable to us, we cannot make the booked accommodation available, we refund everything you have paid and look for alternative accommodation of an equivalent standard at no additional cost to you. If the stay becomes impossible for reasons attributable to neither party — in particular where imposed by law or by the authorities — we refund everything paid or, if you prefer, issue credit towards future dates.
Under article 17 of Decree-Law 24/2014 of 14 February, accommodation contracts with a specific date or period of performance are not subject to the 14-day right of withdrawal that applies to distance purchases generally. The cancellation conditions above apply instead, and are shown to you before you confirm your booking.
Check-in is from 4:00 pm and check-out until 11:00 am, unless otherwise agreed. Whenever occupancy allows, we offer flexible timings — just ask in advance.
Online check-in: after confirmation we send you a link where you can provide identification details for every guest, your expected arrival and departure times and, where applicable, your flight number. We send a reminder a few days before arrival.
Using the form is optional; providing the identification details is not. The law requires every guest staying to be registered and reported to the competent authorities, so any details not provided online must be given at check-in. Doing it in advance simply saves time on the day you arrive.
The guest is responsible for damage caused to the apartment or its contents during the stay, whether by themselves or by their party. A security deposit may be requested and is returned after the apartment has been checked.
PNstays is not liable for loss of or damage to personal belongings left in the apartment, nor for interruptions to services beyond its control (for example, failures of the public electricity, water or internet networks).
Luggage storage: whenever we are able to, we will hold luggage before check-in or after check-out. This is a courtesy and not a left-luggage service: we do not open, check or record the contents of any bag, luggage remains at the guest's own risk, and we are not answerable for its contents. Please do not leave valuables, money, electronic equipment or documents with us: please keep those on you.
Accessibility: access to Santiago II is by stairs, on a steep street, and it is therefore not suitable for guests with reduced mobility. Santiago I and Santiago III are on the first floor and served by a lift.
Nothing in these terms excludes or limits liability that the law does not allow to be excluded or limited, in particular in cases of wilful misconduct or gross negligence.
You may submit a complaint through the Portuguese electronic Complaints Book. In the event of a consumer dispute, consumers may turn to an alternative dispute resolution body under Portuguese Law no. 144/2015 of 8 September. In the Autonomous Region of Madeira, the competent body is the Madeira Consumer Dispute Arbitration Centre. The European online dispute resolution platform is also available.
These terms are governed by Portuguese law. The courts of the district of Funchal have jurisdiction over any dispute, without prejudice to the consumer's statutory right to bring proceedings in the courts of their own domicile and to use alternative dispute resolution.
